LMIA Based Work Permit

A Labour Market Impact Assessment, LMIA, is a legal document issued by the government of Canada to the employer. A labour market impact assessment (LMIA) is issued by the federal department of Economic and Social Development Canada (ESDC). It is an opinion that allows an officer to assess the effect that a permanent job offer to a foreign worker will

have on Canada’s economy (positive, negative, or neutral).

 

Several factors are considered, such as wages, working conditions, the availability of Canadians or permanent residents to do the work, and the skills and knowledge transfer and job creation that may result from employing a foreign worker. A positive LMIA means that the hiring of a foreign worker would have a beneficial impact on Canada’s labour market.  LMIA will allow the applicant, a skilled worker, to get a work permit to work in Canada. The government will issue either a negative or positive LMIA to the employer after applying. 

Available Programs

LMIA Applications

There are mainly three types of LMIA applications:

  • Low wage LMIA

    • If the wage Paid to TFW(temporary foreign worker) is less than $23.08 than the application is considered Low wage. Service Canada approves Low wage positions for employment duration of 1 year

  • High wage LMIA

    • If the wage rate is more than $23.08/hour then the application is considered as high Wage LMIA. We are easily able to get an approval of 2 years for Employment duration.

  • LMIA to Support Permanent residency

    • You can  support a TFW to become a Permanent resident of Canada through this LMIA.

​Labour Market Impact Assessment

​

The TFWP has specific requirements for employers depending on the labour market stream of the temporary worker. A prospective employer must submit its job contract and apply to ESDC for an LMIA. ESDC is responsible for confirming that the job offer conforms to current rules and regulations, including assessing the employment contract and conducting an employer compliance review. ESDC assesses the employer’s application for the LMIA based on a number of factors, including but not limited to the following:

1. the employer is actively engaged in the business in which the worker will be

employed

2. the job offer is consistent with the needs of the employer

3. the employer is reasonably able to fulfill the terms of the job offer 

4. the employer has complied with federal and provincial/territorial laws

regulating employment in the province/territory where the worker will be employed
